Although Denmark managed to stay neutral throughout World War I, it nevertheless generated a heated debate in the country; most people took a clear stand for one side or the other. After the traumatic Danish defeat in the 1864 war with Prussia and Austria, Germany was regarded as the arch enemy and not unexpectedly mostDanes sided against the Central Powers in the public debate. This was not least the case amongst the national-conservative politicians, intellectuals and artists. La philosophie du droit a pour fonction d’assister la réflexion sur le monde du juridique, sur « le droit qui se fait », sur la doctrine juridique et notre façon de l’écrire, et sur l’appréciation (ou l’indifférence, l’hostilité, etc.) qu’un individu distancié peut éprouver à l’égard du droit et des juristes. Elle assiste et elle participe en examinant notre façon d’opérationnaliser les sources du droit, de forger des arguments pouvant être juridiques, d’évaluer les narrations qui se présentent au droit, d’examiner (...) la pertinence de la doctrine, notre façon de pratiquer le droit et de faire des jugements judiciaires. Elle ne réside de toute évidence pas « en haut » et elle ne « surplombe » pas l’écriture de la doctrine. Elle ne se glorifie pas en distribuant (en toute incompétence) l’étiquette de « scientificité » au bon candidat, que celui-ci soit auteur d’un article, d’un livre ou d’une théorie. Admettons plutôt lucidement que la philosophie du droit ne donne pas de certificat de « scientificité » et que toute revendication en ce « sens » n’a pas de « sens ». (shrink)

Roughly 80,000 U.S. prisoners are held in solitary confinement at any given time. A significant body of research shows that solitary confinement has severe, long-term effects, and the United Nations has condemned the practice of solitary confinement as torture. For years, prisoners have been organizing hunger strikes in order to protest solitary confinement. But such action is not without consequences, and some inmates have suffered serious injury or death. The question I raise in this paper is whether we ought to (...) force-feed hunger striking prisoners when serious harm is imminent. Both the World Medical Association and the American Medical Association have denounced the practice of force-feeding prisoners on hunger strike, and yet, the practice is common. Such prevalence is likely a result of the tension between the person-as-patient and person-as-prisoner and cannot easily be resolved. Instead, we must take seriously the complaint that solitary confinement is inhumane and avoid placing health professionals in the position where they must choose to force-feed the prisoner against his will or not. I argue that a conventional bioethics debate centering on polarizing principles of prisoner autonomy and a duty-to-protect the prisoner from harm is an inadequate framework for this complex issue. Instead, we must examine the prisoner’s intent and his right to freedom of speech. I argue that when the prisoner’s intent is to raise awareness and communicate with others, his hunger strike is a form of speech. Protest-as-speech is constitutionally protected—even for prisoners—and remains a minimum ethical obligation for society to uphold. (shrink)

The duration varies a lot depending on the reader's pace, but reading literature, just as listening to music, takes a considerable amount of time. This paper critically examines the implications of state efforts to expand prescriptive authority of pharmacists, which will allow them to prescribe various types of hormonal contraceptives. With this expansion, women no longer need to see a physician before being prescribed such contraceptives, but instead, they must answer self-assessment questionnaires at the pharmacy to ensure that their chosen method is safe and appropriate. This paper argues that while these measures to expand pharmacists’ prescriptive authority will surely meet the stated goal to (...) increase access to hormonal contraceptives, the measures may have detrimental consequences that have largely been downplayed. Studies consistently show that the OB-GYN is a significant primary care provider identified by young female patients, and some of the main reasons provided by these young women for going to the OB-GYN is to discuss, or obtain a prescription for, contraceptives. Through the expansion of pharmacists’ prescriptive authority, a likely consequence is that some women will relinquish going to the OB-GYN. However, the OB-GYN provides important services beyond contraceptives, such as preventive screenings for hypertension, cardiovascular diseases, alcohol abuse, mental health, etc., and there is evidence supporting both the effectiveness and cost–benefits of these interventions. By increasing access to contraceptives, the likely result is that many women will have less interaction with a physician and will receive fewer preventive screenings. I do not wish to suggest that these bills should not pass, nor that OB-GYNs should hold contraceptives hostage, only that there are consequences to expanded prescriptive authority that must be anticipated. Further, expanding prescriptive authority obscures the real problem: some individuals have trouble accessing the health care system, not merely trouble accessing hormonal contraceptives. The expansion of prescriptive authority to include contraceptives applies a Band-Aid to treat one aspect of this problem. What is needed is not merely expanded access to hormonal contraceptives, but better access to health care in general. (shrink)

The psychological effects of aesthetic education have often been discussed, and major studies such as Michael Parsons’s inquiry into art understanding show that the development of understanding works of visual art is influenced by education.1 His findings show that the way people talk about art can be structured in five stages of development according to the model of Jean Piaget’s theory of cognitive development. Some public health behavioral intervention research studies involve deception. A methodological imperative to minimize bias can be in conflict with the ethical principle of informed consent. As a case study, we examine the specific forms of deception used in three online randomized controlled trials evaluating brief alcohol interventions. We elaborate our own decision making about the use of deception in these trials, and present our ongoing findings and uncertainties. In this chapter, we argue that trust can be better understood in relation to people’s attempts to deal with vulnerability in social interactions. Different situations afford different forms of adaptation that correspond to different forms of trust. We describe three forms of trust: trust as a decision, trust as a performance and trust as an uncontrollable force. We show how these different types of trust differ with respect to assumptions about trust, trustworthiness and agency as well as with respect to (...) the accompanying emotions and outline a tentative process model of trust. We conclude the chapter by reviewing the contribution of the suggested framework as well as indicating questions for further research. (shrink)

RÉSUMÉ Dans ce texte, l'auteur analyse et réfléchit sur la critique posée par le philosophe allemand Jürgen Habermas à l'encontre du libéralisme politique de son homologue américain John Rawls. Insistant sur quelques thèmes clés, l'auteur se penche, dans un premier temps, sur la critique formulée à l'encontre du modèle d'autonomie politique et individuelle développé par Rawls. Dans un deuxième temps, il examine la position habermasienne à l'égard du discours deformation des normes élaboré par Rawls. The Body Image Questionnaire-20 (FKB-20) is one of the most applied self-report measures in the context of body image assessment in German-speaking regions. A version of the FKB-20 capturing an ideal concept of body image is also available. A special property of the scale is its high sensitivity for individuals suffering from anorexia nervosa. The present research provided a short version of this scale (for both variants) and examined its validity in a representative sample (N= 2,347) of the German population. (...) We utilized factor analysis methods to identify the optimal short scale of the measure, finding excellent model fit and reliability for a two-factor model (FKB-6) for both real and ideal body image. Both versions of the FKB-6 can be considered invariant across sex and age groups. Good reliability indices were shown for both versions of the FKB-6. The reliability indices were similar to those mentioned in previous studies. Our study also revealed, that large discrepancies between the real and an ideal body image are correlated with somatic and body dysmorphic symptoms. Finally, we provided norm values for comparisons of individual scores with the general population. The FKB-6 is a valid and a reliable measure that economizes assessments by clinicians and researchers. (shrink)

Background: The Self-Regulation of Eating Behavior Questionnaire is an economical way of assessing an individual's self-regulatory abilities regarding eating behavior. Such scales are needed in the German population; therefore, the purpose of the present study was the translation and validation of a German version of the SREBQ.Method: First, we conducted a pilot study after the translation procedure. Second, we assessed the final scale in a representative sample of the German population and its underlying factor structure. Further, we tested for measurement (...) invariance and evaluated the SREBQ's associations with related scales to explore convergent and discriminant validity. Finally, we considered differences in SREBQ based on sociodemographic variables and provided derived reference scores.Results: Factor analysis revealed deficiencies in the original model. Thus, we shortened the scale based on statistical considerations and the adapted version showed improved fit in Confirmatory Factor Analysis and reliability. We also found evidence for partial strict invariance, which means the measure is equivalent for the tested groups of age and gender. Item and scale psychometric properties of the shortened version were satisfactory. In terms of diagnostic validity, it was shown that individuals with higher body mass index have worse self-regulation of eating behavior than those with lower.Conclusion: In sum, the SREBQ evidenced good validity and reliability and is suitable for application in medical, psychological, and nutritional research.
